In these Terms and Conditions

“COAST” or “we” means Coast Business Solutions Limited.

“Customer” or “you” means the person, firm or company that has requested any Software.

“Goods” or “Products” means the goods and services specified in the Company's invoice.

ABOUT US
coastsolutions.co.uk is part of a web site operated by Coast Business Solutions Limited.  We are registered in England and Wales under company number 6860980 and our registered office is at Tamar Science Park, 1 Davy Road, Plymouth, Devon, PL6 8BX. Our VAT number is GB948586754.

YOUR STATUS
The coastsolutions.co.uk site is intended for use by people resident in the United Kingdom. We may not accept orders with a delivery address outside the United Kingdom.

By placing an order through the website, you make a binding contractual promise (or ‘warranty’) that:
(a) you are at least 18 years old; and
(b) you are legally capable of entering into binding contracts;
(c) if you are an individual placing an order on behalf of a business or entity which you work for, you are authorised to place it on their behalf.

OUR STATUS
All software is provided subject to the license agreement that is part of the package you receive. You agree to be bound by the license agreement once the package is opened or its seal is broken. We do not warrant any software under this Agreement. Warranties, if any, for the software are contained in the license agreement that governs its purchase and use.

Please note we accept orders for Products as resellers of third party products and services.  The contract to use those third party Products will be between you and that third party seller and is subject to their terms and conditions. They will advise you of these directly, usually when you install or first use their product or service.  You should carefully review those terms and conditions.

We may provide, or third parties may provide, links to other websites. Because we have no control over such sites and resources, you acknowledge and agree that we are not responsible for the availability of such external sites or resources, and does not endorse and is not responsible nor liable for content, products, advertising, or other materials on, or available from such sites or resources. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource. This disclaimer does not affect your statutory rights against the third party seller. We will notify you when a third party is involved in a transaction, and we may disclose your customer information related to that transaction to the third party seller.

CONSUMERS
We do not wish to accept orders from consumers via coastsolutions.co.uk web shop. You should only place an order with us in the course of operating a business, or similar organisation, such as a charity.  Please contact us on info@coastsolutions.co.uk if you are a consumer and wish to order a Product.


DELIVERY
Refer to the COAST Delivery Policy for full details of the applicable delivery terms applying to your order.


HANDOVER OF RESPONSIBILITY FOR AND OWNERSHIP OF THE PRODUCTS
You will be responsible for looking after the Products from the time of delivery to your delivery address, or other location you gave for delivery. All software products are licensed (not sold) in accordance with the terms and expressed in the documentation included with the Goods. We warrant to the Customer only that any Goods supplied by it, function in accordance with any specification provided in documentation accompanying the Goods, provided that the Goods have been used strictly in accordance with the instructions, and, without prejudice to the generality of the foregoing, have been used correctly in accordance with appropriate computer hardware and operating system.

RETURNS POLICY
Returns (Faulty goods) - If the goods were delivered 30 days ago or less, we will offer to refund or replace confirmed-faulty goods once returned as per COAST’s returns procedure. We will help to arrange a resolution under the manufacturer's warranty for items reported after the 30-day period.

Goods damaged in transit - We must be notified within 24 hours of receipt of an item damaged in transit. All of the packaging the item was shipped in should be retained, if the packaging is obviously damaged refuse the delivery or only sign for the items as 'Damaged Packaging, items not inspected'. If the packaging and goods inside are obviously severely damaged refuse the delivery entirely. Once the damaged items are received back in accordance with COAST’s returns procedure we will send a replacement product or, if this is not possible, provide a full refund. Once the goods have been delivered and signed for in good condition responsibility passes to the customer. Goods endorsed as 'received in good condition' or not notified within 24 hours as damaged cannot be guaranteed a replacement product.

Products are under no circumstances sold on a sale or return basis. Should you wish to return a product (at your own expense) and we, at COAST’s absolute discretion may agree to such, a 20% handling charge plus VAT will be levied. Such products returned must fulfil the following conditions:

1. Goods returned must be received in as new condition.

2. Goods must be returned complete including all packaging, manuals for that product. If any items are missing when received then the product is deemed incomplete.

3. The packaging of the goods must be unmarked and undamaged.

4. The goods remain the customer's responsibility during transit and until signed for by COAST.

6. If upon receipt the returned goods fail to meet the above conditions then COAST may refuse to accept the goods.

7. Any refund for the goods will be made by the same payment method and to the same card that was used to make the purchase. All refunds will be undertaken within 30 days of the return. Refunds cannot be made for postal charges incurred by the customer in returning the goods to us.


PRICE AND PAYMENT
The price of any Products will be as quoted on the Coast Business Solutions web shop, except in cases of error.
The amount of VAT in COAST’s prices is always specified. Prices given on the web shop pages exclude delivery costs which will be displayed with the total amount due when you go to your shopping basket, prior to you paying for your order. 
We may change our prices at any time, but changes will not affect orders for which we have already sent you a Dispatch Confirmation.
coastsolutions.co.uk contains a large number of Products and it is always possible that, despite our best efforts, some of the Products listed may be incorrectly priced. We are under no obligation to provide the Product to you at the incorrect price, even after we have sent you a Dispatch Confirmation, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as mis-pricing.

OUR CONTRACTUAL PROMISES AND LIABILITY
COAST warrants to the Customer only that any Goods supplied by it, function in accordance with any specification provided in documentation accompanying the Goods, provided in always the Goods have been used strictly in accordance with COAST’s instructions, and, without prejudice to the generality of the foregoing, have been used correctly in accordance with a suitable computer operating system. All software products are licensed (not sold) in accordance with the terms and expressed in the documentation included with the Goods. Save as herein provided, all representations, conditions, warranties or other terms expressed or implied or whether statutory or otherwise are hereby expressly excluded.

Under no circumstances shall COAST be liable to the Customer or to third parties for loss (including, but not limited to, profit or data) damage or injury howsoever arising. In any event, the total liability COAST shall have to the Customer shall not exceed the value of the Goods covered by the invoice. In the case of Goods not of the COAST’s manufacture, COAST will extend the Customer the benefit of any guarantee, warranty or condition which may have been granted to COAST by the supplier of the Goods and will take such steps as the Customer may reasonably require to enforce such rights but save as aforesaid no condition or warranty is given by COAST in relation to such Goods that are not of its manufacture. The warranties in this clause in no way invalidate any statutory right of the Customer.

The failure by COAST at any time or for any period to enforce any one or more of these Terms and Conditions shall not be a waiver of them or a waiver of the right to enforce such Terms and Conditions on a future occasion.

EVENTS OUTSIDE OUR CONTROL
COAST shall not be responsible for any failure to perform its obligations hereunder due to circumstances beyond its control.

SEVERABILITY
The failure by COAST at any time or for any period to enforce any one or more of these Terms and Conditions shall not be a waiver of them or a waiver of the right to enforce such Terms and Conditions on a future occasion.

LAW AND JURISDICTION
The contact between COAST and the customer shall be governed by and construed in accordance with English Law.
